Musk Doesn't Give Up on OpenAI Lawsuit

Elon Musk plans to move forward with his legal battle against OpenAI. He will not give up on the lawsuit, despite the company’s latest move to retain control by its non-profit arm.

Musk’s attorney Marc Toberoff made a statement shortly after OpenAI revealed a revised governance plan for its non-profit parent to maintain control of the company’s for-profit operations, arguing the move failed to address core concerns about transparency and ownership. “Nothing in today’s announcement changes the fact that OpenAI will still be developing closed-source AI for the benefit of Altman, his investors, and Microsoft,” Toberoff said. He added that the new plan “obscures critical details,” highlighting the “sharply reduced ownership stake” held by the non-profit in CEO Sam Altman’s for-profit venture.

An OpenAI spokesperson reportedly responded by calling the lawsuit baseless. The spokesperson claims that Musk’s continued legal push proves that it was always a bad-faith attempt to slow them down. A trial is set for March 2026. Musk, who co-founded OpenAI in 2015 and has launched several lawsuits against the company, argued that Altman’s venture had strayed from its original mission of developing AI responsibly and transparently, even bidding to acquire the company’s non-profit division to block the restructuring.
